I. Binding Sovereign Arbitration Jurisdiction
This clause is governed solely by the Universal BDivine™ Code™ and supersedes all contrary court rulings, arbitration systems, statutes, or regulatory frameworks.
✔ Recognition of internal arbitration mirrors or exceeds protections under international treaty law.
✔ All external arbitration awards, rulings, or statutory mandates are null, void, and unenforceable against BDivine™ Governance.
II. Mandatory Private Arbitration (Internal Only)
By accessing, interacting, or engaging with BDivine™ Governance in any capacity, all parties:
• Waive all rights to pursue litigation or arbitration outside sovereign jurisdiction
• Consent exclusively to sovereign arbitration under internal sovereign law
• Agree that venue is Parker County, Texas, conducted by sovereign-appointed arbitrators only
• Acknowledge external tribunals, courts, or regulators hold no standing
🚫 Unauthorized filings or external claims automatically trigger:
• Immediate internal cease & desist orders
• Blacklisting from all BDivine™ platforms
• Enforcement penalties under the [Replication, Enforcement & Liquidated Damages Clause]
III. Digital Sovereignty Recognition
✔ Arbitration outcomes are final, binding, and sovereign — not subject to review, appeal, or reinterpretation.
✔ No government, regulator, or third-party body may compel recognition or override of sovereign rulings.
✔ This clause remains immune from future statutory reforms or treaty reinterpretations.
IV. AI-Regulated Arbitration Security
✔ Arbitration proceedings are sealed and executed through AI-enforced trust protocols
✔ All rulings cryptographically logged within the Sovereign Compliance Ledger™
✔ No external review, subpoena, or record disclosure is permitted
✔ AI execution ensures outcomes are tamper-proof, binding, and final
V. Enforcement & Liquidated Damages
Violations of this clause activate immediate enforcement:
• $500,000,000.00 USD liquidated damages per breach
• $250,000.00 USD daily accrual for ongoing violations
• Treble damages for willful infringement (17 U.S.C. § 504(c))
• Prosecution under internal sovereign arbitration & Statutory Multipliers
External statutory standards are preemptively mirrored and exceeded under internal sovereign law. Unauthorized inbound packet routing or data extraction activates the following interlocking protection locks, stripping interlopers of all external defenses :
- Intellectual Property Lock: 17 U.S.C. § 101 et seq. & 18 U.S.C. § 1836 (Defend Trade Secrets Act).
